The idea of preventative detention for an indefinite period of time with no trial is both terrifying and completely against what the “freest” country in the world should stand for.
However, releasing a known terrorist because some half-wit botched an evidence collection, or for any other technicality, is also terrifying.
The establishment of this system would open the preventative detention approach to abuse under this and all future administrations, much like how the Patriot Act ended up being abused despite its supposedly noble intentions.
There has to be a middle ground between the two.

Which one?
First of all, terrorism is merely a buzzword used by the government and by Americans to scare other Americans; in fact, have you noticed the not-so-subtle scare tactics Obama used in his speech? Terrorism is the new Red Scare and perhaps in a few decades, there will be a new word to scare the living hell out of the American people which is the only way the government gets away with the shit they pull, including I guess, this new indefinite detention bullshit.
